Groundswell Giving Ltd values and respects the privacy of the people we deal with. Groundswell Giving Ltd is committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) (Privacy Act) and other applicable privacy laws and regulations.

This Privacy Policy (Policy) describes how we collect, hold, use and disclose your personal information, and how we maintain the quality and security of your personal information. 

What is personal information?

“Personal information” means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies you either directly (e.g. your name) or indirectly.

What personal information do we collect?

The personal information we collect about you depends on the nature of your dealings with us or what you choose to share with us.

The personal information we collect about you may include:

  • Your name and contact details

  • Payment information and banking details if you are ; 

  • Personal Information contained in forms or applications; 

  • Personal Information contained in queries, or feedback about our services;

  • Usage data (which may include your IP address, the pages you have clicked through on our websites, websites that referred you to our sites, information about the device you are using, and your wider geographic location).

How do we collect your personal information?

We ask you for Personal Information when it is reasonably necessary for the activities in which you are seeking to be involved. We will only collect your Personal Information by lawful and fair means, including by telephone, by letter, by email, through forms on our websites or through websites we trust.

Normally, we collect your Personal Information directly from you (or the relevant individual), unless it is unreasonable or impracticable to do so. Subject to this Policy, we may collect Personal Information from agents, contractors, subcontractors, employees, representatives, users of Groundswell Giving Ltd’s services, and volunteers.

On occasion, we may collect Personal Information from a third party. For example, Personal Information may be provided by third party websites. We collect user data through log files and cookies. In some cases you can block or delete cookies and still use our services, although if you do, you will be asked for your email address and password every time you log into an account you hold with us.

We generally obtain consent from the owner of Personal Information to collect their Personal Information. Consent may be provided in writing, or may be provided orally, or may be implied through a person’s conduct. 

You are not required to provide the Personal Information and/or Sensitive Information we request. However, if you choose not to provide it, we may not be able to service your needs. 

You are free to browse our website anonymously. However, when you are registering for one of our services, we require you to register an account using your name or a pseudonym and provide a valid email address. It is impractical for us to manage and provide support if we cannot match you to your account. 

Receipts (especially tax deductible receipts) may be invalid unless accurate information, including your real name, is provided.

How we deal with unsolicited Personal Information

If we receive your Personal Information from you or a third party without having asked for it, and we determine we do not have a need for it, we will destroy or deidentify the information as soon as practicable, so long as it is lawful and reasonable to do so.

How do we use your personal information?

We use personal information only in connection with our purpose, including to:

  • improve our services through quality-improvement activities;

  • process payments, including donations;

  • communicate important service-related announcements, changes to our services or policies, or password notifications;

Third party service providers

Groundswell Giving Ltd uses some third party service providers (sub-processors) in order to support our websites and operations. These third party service providers can include foreign entities that operate in an overseas jurisdiction. We select reputable third party service providers on the basis of their published privacy policies. 

We may disclose your personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect us to disclose your information.

By using our services and interacting with Our Community, you acknowledge that third party service providers that are foreign entities may not be required to protect your Personal Information in a way that provides comparable safeguards as those provided in the Privacy Legislation.

How do we store and handle your personal information?

We hold Personal Information in a number of ways, including in electronic databases and email contact lists. We take reasonable steps to: 

  • make sure that the Personal Information is accurate, up to date and complete, and (in the case of use and disclosure) relevant;

  • protect the Personal Information from misuse, interference, loss, unauthorised access, destruction, modification or disclosure; 

  • destroy or permanently de-identify Personal Information that is no longer needed. (However, we will keep information for a longer period where necessary to comply with contractual, regulatory or legal  requirements.

How do we protect your personal information?

Groundswell Giving Ltd will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure, including by:

  • taking measures to restrict access to only personnel who need that personal information to effectively provide services to you;

  • having technological measures in place for example, anti-virus software;

  • carefully selecting the platforms in which we store your personal information.

The Groundswell Giving website uses cookies. A cookie is a small file of letters and numbers the website puts on your device if you allow it. These cookies recognise when your device has visited our website before, so we can distinguish you from other users of the website. This improves your experience and the Groundswell Giving website.

We do not use cookies to identify you, just to improve your experience on our website. If you do not wish to use the cookies, you can amend the settings on your internet browser so it will not automatically download cookies. However, if you remove or block cookies on your computer, please be aware that your browsing experience and our website’s functionality may be affected.

Website analytics

Our website uses Google Analytics to help us better understand visitor traffic, so we can improve our services. Although this data is mostly anonymous, it is possible that under certain circumstances, we may connect it to you.

We may send you direct marketing communications and information about our services, opportunities, or events that we consider may be of interest to you if you have requested or consented to receive such communications. These communications may be sent in various forms, including mail, SMS, fax and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth). If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so. 

You may opt-out of receiving marketing communications from us at any time by following the instructions to “unsubscribe'' set out in the relevant communication or by contacting us using the details set out in the “How to contact us” section below.

In addition, we may also use your personal information or disclose your personal information to third parties for the purposes of advertising, including online behavioural advertising, website personalisation, and to provide targeted or retargeted advertising content to you (including through third party websites).

How to access and correct your personal information

Groundswell Giving Ltd will endeavour to keep your personal information accurate, complete and up to date.

If you wish to make a request to access and / or correct the personal information we hold about you, you should make a request by contacting us and we will usually respond within 10 business days. 

Links to third party sites 

Groundswell Giving Ltd’s website may contain links to websites operated by third parties. If you access a third party website through our website, personal information may be collected by that third party website. We make no representations or warranties in relation to the privacy practices of any third party provider or website and we are not responsible for the privacy policies or the content of any third party provider or website. Third party providers / websites are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.

Notification of a data breach

If we become aware of unauthorised access to or loss of your Personal  Information, we will promptly:

  • notify you;

  • investigate the cause;

  • do our best to remedy any consequences; and

  • tell you what steps we have taken to prevent a reoccurrence.

Unauthorised access to or unauthorised disclosure of personal information, or a loss of personal information, are handled in accordance with the relevant authority as follows: oaic.gov.au/privacy/notifiable-data-breaches.

Inquiries and complaints

For complaints about how Groundswell Giving Ltd handles, processes or manages your personal information, please contact admin@groundswellgiving.org. Note we may require proof of your identity and full details of your request before we can process your complaint.

Please allow up to 20 business days for Groundswell Giving Ltd to respond to your complaint. It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with our response to a complaint, you have the right to contact the Office of Australian Information Commissioner (at www.oaic.gov.au/) to lodge a complaint.
